Social Media Stream considers the protection of personal data to be of essential importance. We therefore process your data with the utmost care. With this privacy statement, we inform you about how we handle personal data.

1. Who is responsible for processing your data?

In this privacy statement, Social Media Stream (hereinafter: “Social Media Stream” or “we”) describes how we, as the data controller, handle your personal data.

2. What is personal data?

Information relating to an identified or identifiable natural person is personal data. Whether certain information qualifies as personal data also depends on whether Social Media Stream has legal means which can reasonably be assumed to be used to identify the individual concerned.

3. Personal data we process

We process personal data about you because you provide this data to us when entering into an agreement with us, but also when you use our services and thereby provide us with data, or allow us to record information about your interests and preferences.

Data you provide to us
If you enter into an agreement with Social Media Stream, we may require the following personal data from you:

  • (Company) name and address;
  • Contact details (phone numbers, email addresses);
  • Customer number(s);
  • Financial details (bank account information, quotations, invoices).

In addition, we process the following data in the context of executing an agreement with you or providing a service to you, which may qualify as personal data:

  • Username and passwords;
  • Other data relevant to the specific agreement.

Data about your use of our services and/or products
If you use services from Social Media Stream or otherwise have contact with us, we process – depending on your exact use – the following data which may qualify as personal data:

  • Data relating to your equipment, such as a MAC address, IP address, or other identifier;
  • Your communication preferences and settings;
  • Data linked to certain patterns, such as a status in the profile we compile about you based on your consumption behaviour (e.g., the frequency of purchases or services used);
  • Browsing behaviour, determined by our own observations or cookies (see also section 9 of this privacy statement);
  • Customer satisfaction data;
  • Data about your use of our support department.

4. No processing of data of persons under 16 years of age

We do not intend to collect data from website visitors under the age of 16. We encourage parents to be involved in their children's online activities to prevent Social Media Stream from processing their personal data.

5. Processing: legal bases and legitimate interests

The processing of personal data takes place on the basis of the following legal grounds from Article 6 of the General Data Protection Regulation (GDPR):

  1. Consent
  2. Performance of a contract with you
  3. Legal obligation
  4. Performance of a task carried out in the public interest
  5. Legitimate interest of Social Media Stream or a third party

Legitimate interests include: marketing, advertising, security, (crime) prevention, IT management, research and analysis of our products or services, business operations, legal affairs, internal management.

6. Purposes for processing personal data

Social Media Stream processes your personal data for the purposes listed below. The number after each purpose corresponds to the legal basis mentioned in section 5 of this privacy statement.

  • Building and maintaining the customer relationship, including maintaining a direct relationship between the controller and related financial service providers, including for commercial purposes [basis: 2, 5].
  • Processing orders (including invoicing), handling in financial administrations, and logistical processing [basis: 2, 5].
  • Providing customer service, including services related to the purchase of goods and services, fulfilling warranty obligations and product recalls for our own services, handling complaints and requests [basis: 2, 3, 4, or 5].
  • In certain cases, maintaining communication to proactively contact users in connection with product defects or malfunctions, or to schedule service appointments, including enabling mobility services [basis: 2 or 5].
  • Conducting market research to improve our business operations, brands, services, and products [basis: 5].
  • Communicating with data subjects and providing a loyalty programme [basis: 1 or 5].
  • Approaching you with offers or other commercial information. You always have the option to opt out by objecting. All communications indicate how you can do this [basis: 1 or 5].
  • Improving the content of our communication by tailoring it to your personal preferences [basis: 5].
  • (Further) developing and improving new and existing products and services [basis: 5].
  • Measuring customer satisfaction, providing management information, and determining overall business strategy [basis: 1 or 5].
  • Organising events for data analysis purposes to improve or develop products or services, where participants at these events work with personal data in (pseudo)anonymous form – not directly traceable to you as a natural person – insofar as permitted under applicable law [basis: 5].
  • Complying with legal obligations, settling disputes, and enforcing our rights and agreements [basis: 3, 4, or 5].
  • Improving data quality using address validation techniques [basis: 5].
  • Linking and analysing cookies from our websites to customer data known to us, in order to tailor our communications to your personal preferences as closely as possible [basis: 1 or 5].

7. Sharing with third parties

Social Media Stream shares your personal data with third parties in the cases listed below and for the associated reasons. The number after each purpose corresponds to the legal basis mentioned in section 5 of this privacy statement:

  • With affiliated financial service providers to offer complementary financial services [basis: 2];
  • If we are legally required or authorised to provide personal data to third parties [basis: 3];
  • If we suspect a violation of third-party rights, criminal offences, or abuse, we may provide personal data to third parties who have a legitimate interest in it, or to bodies serving the public interest. These may also include enforcement authorities, such as the Public Prosecutor’s Office or supervisory authorities [basis: 3, 4, or 5];
  • With parties that assist Social Media Stream in its services and are not processors (such as accountants and (legal) advisers) [basis: 5];
  • For business economic purposes (such as the sale of business activities or shares, or a reorganisation) [basis: 5].

Social Media Stream also uses services from third parties that act as ‘processors’ (for example, hosting providers, mobility service providers, and research agencies for market or customer satisfaction surveys). These service providers will only process personal data in accordance with the instructions and under the control of Social Media Stream.

8. How long we retain data

We retain personal data in accordance with our internal data retention policy and/or for as long as (i) you are a customer of Social Media Stream or continue to show interest in our services, (ii) we are legally obliged to retain data, or (iii) we have good reason to believe we may retain the data, where necessary. Personal data you provide via the contact or complaint form will be retained for analysis purposes for a maximum of 2 years, after which we anonymise the personal data.

9. Website visit tracking

When you visit or use our websites, services, applications, communication services (such as email) and tools, we may use cookies, web beacons, and other similar technologies for storing information in order to personalise advertisements and offer you a better, faster, and safer customer experience. If you do not want cookies, you can refuse them.

10. Your rights, including the right to object

You have the right to know which personal data we have recorded about you and to whom we have disclosed your personal data. You can contact our customer service for this. Social Media Stream will make every effort to respond within the statutory period. We may refuse excessive requests.

In addition to the right of access, you have the following rights regarding our processing of your personal data:

  • The right to withdraw your consent, insofar as our processing of your personal data is based on it;
  • The right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens);
  • The right to have your personal data rectified/corrected;
  • The right to have your personal data erased;
  • The right to restriction of processing concerning you;
  • The right to data portability;
  • The absolute right to object to direct marketing;
  • The right to object to processing carried out for the legitimate interests of Social Media Stream or a third party (depending on your personal circumstances).

You can only exercise your rights to the extent granted to you by law. To ensure that a request for access is made by you, we ask you to include a copy of your identity document with your request. Please make your photograph, MRZ (machine readable zone; the strip with numbers at the bottom of your passport), passport number, and Citizen Service Number (BSN) unreadable in this copy.

10.1 How to submit a request for erasure (right to be forgotten)

If you wish to exercise your right to erasure of personal data, you can submit a request via info@socialmediastream.nl with the subject “Request for erasure of personal data.” Please include in your email:

  • Your full name and, if applicable, your customer number;
  • A clear description of the data you want to have erased and – if relevant – the service/system it concerns;
  • Contact details where we can reach you for clarification if needed.

To verify your identity, we may ask you to send a copy of a valid identity document. Always make your photograph, MRZ, document number, and BSN unreadable.

Our response and execution: we will confirm receipt of your request and respond within one month of receipt. In exceptional cases (e.g., complex or multiple requests), we may extend this period by two months. If so, you will be informed within one month of receipt of your request, including the reason for the extension.

When we cannot delete (part of) the data: in some cases, we may be required or permitted to retain certain data, for example to comply with a legal retention obligation, for the establishment, exercise, or defence of legal claims, or for reasons of freedom of expression and information or significant public interest. If this applies to your request, we will explain it in our response.

Informing third parties: insofar as we have shared your data with third parties and erasure takes place, we will – where possible and reasonable – inform these recipients of your erasure request.

Marketing exception: if you no longer wish to be contacted for direct marketing purposes, we will remove your data for that purpose and may store your email address in a separate opt-out list to prevent future marketing.

Costs: submitting and handling an erasure request is free of charge, unless requests are manifestly unfounded or excessive.

11. Data security and protection

Social Media Stream applies appropriate security measures to prevent misuse, loss, unauthorised access, unwanted disclosure, and unauthorised modification of your personal data. Social Media Stream has implemented both technical and organisational measures to protect your personal data. These measures are periodically reviewed based on threats.

13. Changes
